6. SMS Text Messaging

This section constitutes the full Terms of Service for the Kesler CPA Review SMS messaging programs. If you have opted in to receive SMS (text message) communications from us, the terms in this section apply to you in addition to the rest of this Privacy Policy.

6.1 Program Description

Kesler CPA Review operates two SMS messaging programs:

TRANSACTIONAL SMS PROGRAM โ€” Account and order-related messages, including: receipts, subscription renewal notices, shipping updates, login links, password resets, and account security notifications.

PROMOTIONAL SMS PROGRAM โ€” Marketing and educational messages, including: CPA study tips, new training announcements, promotional offers, cart reminders, exam deadline reminders, and product updates.

You opt in to each program separately at checkout, on our quiz results pages, or at designated sign-up locations on our website and app. Consent to one program does not constitute consent to the other.

6.2 Opt-In Consent

Before we send you any automated text message, you must provide prior express consent (for transactional messages) or prior express written consent (for promotional messages), as required by the Telephone Consumer Protection Act (TCPA) and applicable state law.

You provide this consent by:

  • Actively checking a compliant consent checkbox during checkout at ThriveCart
  • Actively checking a compliant consent checkbox on a quiz results page, lead capture form, or landing page
  • Providing your phone number in response to a clear sign-up invitation on our website or app with all required disclosures visible at the time of sign-up

Consent to receive promotional text messages is NEVER a condition of purchasing any product or service from Kesler CPA Review. You can purchase any of our products or services without opting in to promotional SMS.

6.3 Message Frequency

TRANSACTIONAL SMS: Frequency varies based on your account activity. You may receive messages any time your subscription renews, an order ships, you request a password reset, or similar events occur.

PROMOTIONAL SMS: Approximately 4-8 messages per month on average. Frequency may be higher during promotional windows (cart opens, launches, or during a multi-day tip series) and lower outside those windows.

6.4 Message and Data Rates

Message and data rates may apply. Your mobile carrier may charge you for each message sent or received, depending on your carrier plan. Kesler CPA Review does not charge you to receive our text messages, but we are not responsible for any charges imposed by your carrier.

If you have questions about charges, contact your mobile carrier.

6.5 Supported Carriers

Our SMS programs are compatible with all major US mobile carriers, including: AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost Mobile, Cricket Wireless, MetroPCS, Virgin Mobile, and most regional carriers and MVNOs.

We do not guarantee delivery of messages on any particular network. Carriers are not liable for delayed or undelivered messages.

6.6 How to Opt Out (STOP)

You can opt out of our SMS programs at any time. To opt out:

Reply STOP to any text message you receive from us. You can also use any of the following words: QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE.

After you opt out, you will receive one final confirmation message confirming your unsubscription. You will not receive any further promotional messages after that confirmation.

Opting out of one program (transactional or promotional) does not automatically opt you out of the other. If you want to opt out of both, reply STOP and then email support@keslercpareview.com confirming you want to be fully removed from all SMS programs.

Note: Opting out of transactional SMS may affect your ability to receive important account-related notifications, including subscription renewal warnings. Consider whether you want to stay subscribed to transactional messages even if you unsubscribe from promotional messages.

We honor opt-out requests within 10 business days, as required by FCC regulations effective April 11, 2025.

6.7 How to Get Help (HELP)

Reply HELP to any of our text messages to receive a help response with our contact information. You can also email support@keslercpareview.com anytime for assistance.

6.8 What to Expect in Our Messages

Every marketing SMS from Kesler CPA Review will:

  • Identify Kesler CPA Review as the sender
  • Include instructions to reply STOP to opt out
  • Contain content related to CPA exam preparation, our courses, or our promotions

We will not:

  • Send you messages outside 8:00 AM to 9:00 PM in your local time zone (or such other hours as required by federal and state law)
  • Share your phone number with third parties for their marketing purposes
  • Use your phone number for any purpose other than the SMS programs you consented to and account-related communications

6.9 SMS Data We Collect

When you subscribe to our SMS programs, we collect:

  • Your phone number
  • Your consent record (timestamp, IP address, opt-in form used, consent language presented)
  • Your message history and engagement data (delivered, responded, opted out)
  • Your SMS carrier information (for compatibility and delivery)

6.10 How We Share SMS Data

Your phone number and SMS data are shared with our SMS delivery platform (Mobile Text Alerts) and our email marketing and CRM platform (ActiveCampaign) solely for the purpose of operating our SMS and email programs. These providers are bound by their published privacy policies and by the commercial agreements governing our use of their services, and may not use your data for their own marketing purposes.

Our workflow automation tool (n8n) is self-hosted on our own infrastructure. n8n the software vendor does not receive or process your data; the software runs on servers we control.

We do not sell, rent, or share your phone number with third parties for their marketing purposes.

6.11 Your Rights Under TCPA and State Law

You have the right to revoke your consent to receive SMS messages from us at any time, through any reasonable means. We will honor your revocation within 10 business days, as required by FCC regulations effective April 11, 2025.

If you believe we have sent you SMS messages without proper consent or failed to honor your opt-out request, contact us immediately at support@keslercpareview.com.

Under federal TCPA, violations may be subject to statutory damages of $500 to $1,500 per message. Under North Carolina state law (N.C. Gen. Stat. ยง 75-100 et seq.), civil penalties for the first violation are $500, second violation $1,000, and $5,000 for each violation thereafter within two years.

6.12 Phone Number Changes and Reassignment

If you change your phone number or it is reassigned to a new person, notify us at support@keslercpareview.com. Consent given by a previous holder of a phone number does not transfer to the new holder.

If you receive SMS messages from us at a phone number that was reassigned to you, reply STOP or contact support@keslercpareview.com to be removed from our list immediately.

6.13 Dormant Accounts

If you have not engaged with any SMS we have sent in over 12 months, we may treat your consent as having lapsed and remove you from our list. You may re-opt in at any time through our checkout, quiz funnel, or dedicated SMS signup pages.

6.14 Record Keeping

We maintain proof of your SMS consent, including the date and time you opted in, the IP address from which you opted in, the form or page where consent was collected, and the exact consent language presented. We retain these records for at least 4 years from the date of your last SMS interaction, consistent with TCPA statute of limitations.

6.15 Changes to These SMS Terms

We may update this Section 6 from time to time. Material changes will be disclosed by updating the "Last Updated" date at the top of this Privacy Policy and, for significant changes to the SMS programs, by notification via SMS or email. Your continued receipt of SMS messages after a material update constitutes your acceptance of the updated terms. If you do not agree to changes, reply STOP to opt out.
